Easy to Make Rent Agreement



 

We are a property management company. Many of our owners have many questions regarding the leave and license agreement process. Sometimes they are doing it for the first time, and some still remember the old method of visiting the registrar office, waiting in a long queue, and wasting a day off to complete the process.

I still remember till 2013, It used to be a very cumbersome process, plan well in advance, take a day off, go to a registrar office, used to wait in a long queue. Once the registration was over, then visit the police station of your area to get the police verification where you had to pay to get the signature and a stamp. 

 

Whenever I get an inquiry for renting a property, the first question people ask, do my parents/friend or relative need to visit the registrar office? Do they need to take a day off for signing the agreement? I have given you property index II, PAN card and Aadhar card can you execute for me? Can we do notarized agreement and so on. In some of the cases, the tenants try to forge the owner’s signature and try to make a notarized rent agreement. 


The most common question Ghar Befikar clients have is regarding the Leave and License Agreement. The old procedure of property registration was cumbersome. It involved spending long hours in a queue. First at the registrar office, then at the police station to get a police verification. People would spend an entire day to complete the process. 



This made me write a blog to help my clients/ followers who are looking to rent their property but afraid of troubling their relatives/parents/friends to do the Leave and License agreement. In Maharashtra, notarized agreements are not accepted by the societies. Maharashtra is one of the first states where the Online Leave and License Agreement process has been made simple and straightforward. 


 We use a standard Maharashtra government approved Leave and License template for preparing the document. The online agreement has all the necessary clauses, miscellaneous clauses can be added. One can add all the fixtures that you have given along with your property.


The following documents are required for this process


If the owner is executing the agreement 

  1. Owner’s PAN and Aadhar card 

  2. Tenant’s PAN and Aadhar card


If the owner is executing the agreement through the power of attorney holder

  1. Owner’s PAN Card

  2. POA holder’s PAN and Aadhar card

  3. Tenants PAN and Aadhar card


The document is created and a draft copy is shared with the owner. The tenant and the owner/POA holder give their biometric and photo to execute the agreement. As of 2020,  a provision has been made to submit police verification at the time of Leave and License Agreement to the area police station.
